Eargasm x Beyond Wonderland Socal 2025 Giveaway

Entrants must be 21 years of age or older and legal residents of the U.S. This giveaway is not sponsored, endorsed, or administered by Instagram. All questions should be directed to Eargasm. Travel and accommodations are at the winner’s expense. By entering, you agree to these rules and confirm your eligibility for participation.

Eligibility: The Eargasm Giveaway ("Giveaway") is open to legal residents of the United States who are 21 years of age or older at the time of entry.

Sponsor: The Giveaway is sponsored by Strand Industries, LLC (“Eargasm”), whose principal place of business is 6925 Canby Ave, Suite 105 RESEDA, California 91335, United States.

Agreement to Rules: By participating, the entrants ("You") agrees to be fully and unconditionally bound by these Terms and Conditions. You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept Sponsor’s decisions as final and binding as they relate to the content of this Giveaway.

Giveaway Period: Entries will be accepted online starting on March 12, 2025, at noon PT and ending on March 16, 2025, at 11:59 PM PT. All online entries must be received by March 16, 2025, at 11:59 PM PT. The winner will be announced on March 17, 2025.

How to Enter: The Giveaway must be entered by submitting an entry via social media platform, https://www.instagram.com/eargasm/, or website on the official entry form as instructed in the Giveaway announcement. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Eargasm. You may enter only once. You must provide the information requested. If You use fraudulent methods or otherwise attempt to circumvent the rules, Your submission may be removed from eligibility at the sole discretion of Eargasm.

Prizes: One winner of the Giveaway (the "Winner") will receive two (2) VIP 2-Day passes to the 2025 Beyond Wonderland®Festival in San Bernardino, California, on March 28-29, 2025 and two (2) sets of Eargasm x Beyond Wonderland®Earplugs. Parking, travel and accommodations are not included and are the sole responsibility of winner and guest. Pass delivery method is at sole discretion of Live Nation/Sponsor which will be either sent to winner by mail, email, mobile ticketing or placed at venue Will Call the day of Festival under the winner’s name. The winner and guest must be present to pick up passes and a valid photo ID will be required if tickets are placed at Will Call. Winner and guest must be at least twenty-one (21) years of age and must abide by all venue and Festival policies: https://socal.beyondwonderland.com/guide/faq/, to include but not limited to, showing a valid photo ID at venue for age verification and/or identification purposes if requested. Live Nation reserves the right to revoke full or partial prize from any winner or guest who it and/or Festival/venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any Festival/venue policy or law, and/or may bring Live Nation into disrepute. Winner understands that there are inherent risks involved in being in public spaces and that these risks may be present before, during and after the Festival. Resale of passes is prohibited. By claiming passes, you agree to Front Gate Tickets Terms of Use and to abide by the health and safety measures in effect at the time of the Festival. Should the Festival be cancelled, you will be notified as soon as reasonably possible. Approximate Retail Value of the prize is: Seven Hundred Seventy One Dollars and Eighty Six Cents ($771.86). Winner and guest must abide by all Festival and venue policies. Insomniac reserves the right to revoke full or partial prize from any winner or winner’s guest who it or venue/Festival personnel deem may, in its sole discretion, be intoxicated, be a safety risk, have violated any venue/Festival policy or law, or may bring Festival into disrepute. Winner and guest must have a valid state-issued driver’s license or Real ID-compliant license or ID for identification purposes and to claim tickets. Winner understands that there are inherent risks involved in attending an event in a public place and that these risks may be present before, during and after the Festival. An unclaimed and/or unused prize element will remain the property of Insomniac. Resale of tickets is prohibited.

Eargasm shall solely determine the specifics of the prize. No cash or other prize substitution shall be permitted except at Eargasm's discretion. The prize is non-transferable. Any prize-related expenses, including without limitation any federal, state, and local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the Winner is permitted. Acceptance of the prize constitutes permission for Eargasm to use the Winner's name, likeness, and entry for advertising and trade without further compensation unless prohibited by law.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: A random drawing will be conducted under the supervision of Eargasm to select the winner. The winner will be notified by Instagram DM following the selection of the Winner. Eargasm shall have no liability for the Winner's failure to receive notices due to spam, junk email, or other security settings or for the Winner’s provision of incorrect or non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within [2] days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt by the Winner of the prize offered in this Giveaway is conditioned upon compliance with any federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (AT EARGASM'S SOLE DISCRETION WILL RESULT IN THE WINNER’S DISQUALIFICATION AS THE WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS THE WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering, you grant Eargasm and its affiliates the right to use your entry, name, likeness, and any statements for promotional purposes in any media worldwide without further compensation. You represent and warrant that your entry is original and does not infringe on any third party’s rights. If your entry violates intellectual property rights, You agree to defend, indemnify, and hold Released Parties (defined below) harmless from any claims or damages arising from such infringement.

Terms & Conditions: Eargasm reserves the right to cancel, modify, or suspend the Giveaway if issues beyond its control affect its fairness or integrity. Eargasm may disqualify anyone who tampers with the entry process or violates the rules. Attempts to damage the Giveaway or website may result in legal action.

Limitation of Liability: By entering, you release Eargasm, Live Nation Worldwide, Inc., (“Live Nation”), Insomniac Holdings, LLC, Insomniac, Inc., Insomniac Entertainment, Inc., the National Orange Show, County of Citrus Fairs; County of San Bernardino (collectively “Beyond Wonderland”) prize providers, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively the “Released Parties”), from and against any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Giveaway, including without limitation (a) the unauthorized or illegal access to personally identifiable or sensitive information; (b) acceptance, possession, use, misuse, or nonuse of the prize that may be awarded; (c) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (d) technical and/or communications malfunctions, errors or failures of any kind; (e) unauthorized human intervention in any part of the Giveaway; (f) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (g) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Giveaway or receipt or use or misuse of any prize; or (h) any claims based on publicity rights, defamation or invasion of privacy. You agree that in any cause of action, the Released Parties’ liability shall be limited to the cost of entering and participating in the Giveaway and in no event shall the Released Parties be liable for attorneys’ fees or other legal costs.

Disputes: This Giveaway is governed by U.S. and California laws. Disputes must be resolved individually in California courts without class action, and participants waive any right to punitive or consequential damages, including attorney’s fees.
