Eargasm Giveaway Terms and Conditions
- Eligibility
The Eargasm Giveaway ("Giveaway") is open to legal residents of the United States who are 18 years of age or older at the time of entry.
- Sponsor
The Giveaway is sponsored by Eargasm ("Sponsor"), with a principal place of business at 6925 Canby Ave Suite 105 RESEDA, California 91335, United States.
- Agreement to Rules
By participating, the contestant ("You") agrees to be fully and unconditionally bound by these Terms and Conditions, and You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept Eargasm's decisions as final and binding as they relate to the content of this Giveaway.
- Giveaway Period
Entries will be accepted online starting on August 23, 2024, at midnight PT and ending on September 1, 2024, at 11:59 PM PT. All online entries must be received by August 30, 2024, at 11:59 PM PT.
- How to Enter
The Giveaway must be entered by submitting an entry via social media platform(s) or website, as instructed in the Giveaway announcement. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Eargasm. You may enter only once. You must provide the information requested. You may only enter once, as indicated by using multiple email addresses, identities, or devices to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, Your submission may be removed from eligibility at the sole discretion of Eargasm.
- Prizes
The winner(s) of the Giveaway (the "Winner") will receive One pair of Eargasm High Fidelity Earplugs at the North Coast Festival. Eargasm shall solely determine the specifics of the prize. No cash or other prize substitution shall be permitted except at Eargasm's discretion. The prize is non-transferable. Any prize-related expenses, including without limitation any federal, state, and local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the Winner is permitted. Acceptance of the prize constitutes permission for Eargasm to use the Winner's name, likeness, and entry for advertising and trade without further compensation unless prohibited by law.
- Odds
The odds of winning depend on the number of eligible entries received.
- Winner Selection and Notification
A random drawing under the supervision of Eargasm will select the winner. The winner will be notified by text or email within one (1) day following the selection of the Winner. Eargasm shall have no liability for the Winner's failure to receive notices due to spam, junk email, or other security settings or for the Winner’s provision of incorrect or non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within [2] days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt by the Winner of the prize offered in this Giveaway is conditioned upon compliance with any federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (AT EARGASM'S SOLE DISCRETION) WILL RESULT IN THE WINNER’S DISQUALIFICATION AS THE WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS THE WINNER WILL BE IMMEDIATELY TERMINATED.
- Rights Granted by You
By entering, You grant Eargasm and its affiliates the right to use your entry, name, likeness, and any statements for promotional purposes in any media worldwide without further compensation. You represent and warrant that your entry is original and does not infringe on any third party’s rights. If your entry violates intellectual property rights, You agree to defend, indemnify, and hold Eargasm harmless from any claims or damages arising from such infringement.
- Terms & Conditions
Eargasm reserves the right to cancel, modify, or suspend the Giveaway if issues beyond its control affect the fairness or integrity of the contest. Eargasm may disqualify anyone who tampers with the entry process or violates the rules. Attempts to damage the Giveaway or website may result in legal action.
- Limitation of Liability
By entering, You release Eargasm and its affiliates from any liability for any injury, loss, or damage arising from your participation or use of any prize. This includes technical failures, unauthorized tampering, or errors in the Giveaway process.
- Disputes
This Giveaway is governed by U.S. and California laws. Any disputes must be resolved individually in California courts, without class action, and participants waive any right to punitive or consequential damages, including attorney’s fees.
- Privacy Policy

- Social Media
The Giveaway hosted by Eargasm is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter, TikTok, or any other social media platform.
- By participating in the Giveaway, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
